MAGICLAB TERMS OF USE

1. Introduction and Acceptance of Terms
1.1 About MagLab
MagLab Game Technologies (“MagLab”, “we”, “our”, or “us”) operates and publishes mobile applications, games, websites, and related digital services under the MagLab brand. Our registered office is located at ODTÜ Teknokent Gümüş Blok, Zemin Kat, ZK-6, Çankaya, Ankara, Türkiye, and you can contact us at [email protected]. These Terms of Use (“Terms”) govern your access to and use of MagLab’s games, websites, and services (collectively, the “Services”). Your use of the Services is also governed by our Privacy Policy, which can be found over https://maglab.com.tr/privacy-policy and explains how we collect, process, and protect your personal data through our use of analytics, advertising, and related technologies.
1.2 Binding Agreement
By downloading, installing, accessing, or using any of our Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Services. You further acknowledge that you are legally capable of entering into a binding agreement under the laws of your jurisdiction. If you are using the Services on behalf of another entity, you represent and warrant that you are authorized to accept these Terms on behalf of that entity. Your continued use of the Services constitutes your acceptance of these Terms in full.
1.3 Modification of Terms
MagLab reserves the right to modify or update these Terms at any time at its discretion. Any such changes will be effective when they are published on our Services or websites. When material changes are made, we will provide reasonable notice, such as updating the “Effective Date” at the top of the Terms or providing an in-app notification. By continuing to use the Services after the effective date of any modification, you agree to be bound by the updated Terms. If you do not accept any change, you must discontinue use of all MagLab Services immediately.
2. Eligibility and Age Requirements
2.1 Legal Age and Parental Consent
The Services are not intended for children under the age of 13, or under the minimum age required by local law to provide consent for data processing and online participation without parental supervision. By accessing or using the Services, you represent that you are at least the minimum age required in your jurisdiction. If you are under the age of 13, you must not use the Services, create an account, or submit any personal data to MagLab.
If you are between the ages of 13 and 18, or otherwise a minor in your country of residence, you may only access and use the Services under the supervision of a parent or legal guardian who has reviewed and consented to these Terms on your behalf. Parents and guardians are responsible for ensuring that minors understand and comply with these Terms and are accountable for all actions of minors using their account or device.
MagLab does not knowingly collect, store, or solicit personal data from children under the age of 13. If we discover that we have inadvertently collected personal information from a child in violation of applicable law, we will take immediate steps to delete such data and may suspend or terminate the related account. Parents or guardians who believe that MagLab may have collected data from their child without consent are encouraged to contact us directly at [email protected].
By allowing a minor to use the Services, you acknowledge and agree that you are responsible for any activities, communications, or transactions conducted by that minor, including in-app purchases and submissions of personal data. MagLab shall not be liable for any damages, losses, or unauthorized charges incurred by a minor’s use of the Services.
2.2 Account Responsibility
You are solely responsible for maintaining the confidentiality and security of any username, password, or account details associated with your use of the Services. You must not share, trade, sell, or otherwise transfer your account or credentials to any other person. You agree to use strong passwords and to take reasonable steps to protect your device and account information from unauthorized access.
If you believe your account or login credentials have been compromised, or if you notice unauthorized activity, you must immediately notify MagLab through our official support channels. MagLab reserves the right to suspend or disable access to your account in order to prevent further unauthorized use or potential harm.
You understand that you are responsible for all activities conducted through your account, whether or not such actions were authorized by you. MagLab shall not be liable for any losses or damages arising from your failure to secure your account, or from any third-party access resulting from negligence, password reuse, or sharing of credentials.
MagLab may, at its discretion, request verification of account ownership or identity before restoring access to an account. You agree to cooperate with such requests and provide accurate, lawful information as necessary to resolve any disputes over account ownership.
Use of the Services
3.1 License Grant
Subject to your full compliance with these Terms, MagLab grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Services for personal, non-commercial entertainment purposes. This license permits you to download and use the MagLab applications and games on compatible devices solely for lawful use consistent with the intended functionality of the Services.
You may not use the Services or any part thereof for commercial exploitation, public performance, or distribution without MagLab’s prior written consent. The rights granted herein do not include any right to copy, reproduce, modify, distribute, or create derivative works based on the Services, except as expressly permitted by MagLab.
MagLab retains all ownership, title, and intellectual property rights in and to the Services and reserves all rights not expressly granted under these Terms. Your license may be revoked at any time if you fail to comply with these Terms or engage in any prohibited activity.
3.2 Account Security and Access
Some features of the Services may require you to create or log into an account. You agree to provide accurate, up-to-date, and complete information during registration and to maintain this information throughout your use of the Services. Providing false or misleading information may result in suspension or termination of your account.
You are responsible for ensuring that access to your account is limited to yourself and authorized users only. You may not impersonate another person or use an account belonging to someone else. MagLab reserves the right to deny the creation of an account, or to remove or reclaim any username, at any time, particularly if such name is deemed offensive, misleading, or violates third-party rights.
In cases where accounts are found to be shared, sold, or transferred without authorization, MagLab may suspend or permanently terminate access without notice. Additionally, MagLab may implement measures to verify account ownership or restrict device access in order to protect user security and prevent fraudulent activity.
Your access to the Services may be temporarily or permanently interrupted for maintenance, updates, or technical reasons. You acknowledge that MagLab is not liable for any loss of progress, in-game items, data, or account information resulting from such interruptions or from account misuse.
3.3 Restrictions and Prohibited Conduct
You agree to use the Services in compliance with all applicable laws, regulations, and these Terms, and you shall not engage in any activity that could interfere with the normal operation, security, or integrity of the Services or other users’ enjoyment thereof.
Specifically, you must not:
- Use any cheats, automation tools, scripts, bots, or exploits to manipulate gameplay, gain an unfair advantage, or alter the intended operation of the Services.
- Reverse engineer, decompile, disassemble, or otherwise attempt to access the source code or underlying structure of any MagLab software or component.
- Access, use, or distribute unauthorized private servers, modified clients, or emulators that replicate MagLab’s Services.
- Circumvent or tamper with security, encryption, or technical protection measures.
- Engage in harassment, threats, hate speech, or any conduct that MagLab reasonably determines to be abusive, offensive, or discriminatory.
- Post, transmit, or share content that is illegal, defamatory, obscene, infringing, or otherwise violates the rights of third parties, including intellectual property and privacy rights.
- Engage in real-money trading, sale, or exchange of virtual currency, game accounts, or in-game assets outside MagLab’s authorized platforms.
- Use the Services to promote or distribute advertising, spam, or unsolicited commercial communications.
- Attempt to disrupt or overload servers, exploit network vulnerabilities, or interfere with other users’ connections or experience.
MagLab reserves the right to determine, at its sole discretion, whether conduct violates these Terms. Any violation may result in penalties, including content removal, account suspension or termination, revocation of virtual assets, or legal action. Repeated or severe violations may lead to permanent bans across all MagLab titles and services.
You acknowledge that MagLab is not obligated to monitor user activity but reserves the right to do so where necessary to ensure compliance with law or to protect its Services, users, or intellectual property.
Ownership and Intellectual Property
4.1 Service Content
All rights, title, and interest in and to the Services — including but not limited to all games, software, source code, databases, artwork, visual interfaces, animations, design elements, sounds, music, audiovisual effects, text, storylines, gameplay systems, characters, environments, trade names, logos, and trademarks — are and shall remain the exclusive property of MagLab Game Technologies and its licensors. The Services, together with all intellectual property and proprietary materials contained therein, are protected by copyright laws, international treaties, trademark laws, and other intellectual property or proprietary rights laws applicable in Türkiye and globally.
Except for the limited license expressly granted to you under these Terms, MagLab does not transfer any ownership or other intellectual property rights to you. You acknowledge and agree that your use of the Services does not confer upon you any right, title, or interest in or to the Services, the underlying technology, or any associated intellectual property, whether by implication, estoppel, or otherwise.
You may not reproduce, copy, modify, decompile, disassemble, translate, distribute, publicly perform, display, republish, or otherwise exploit any portion of the Services or related materials without the prior written consent of MagLab. Any unauthorized use of the Services or its content constitutes a material breach of these Terms and may result in termination of your access and possible legal action.
MagLab reserves all rights not expressly granted herein. Any feedback, suggestions, or ideas submitted by you regarding the Services shall become the property of MagLab without compensation or obligation, and MagLab may use such feedback for any lawful purpose, including product improvement or marketing, without restriction.
4.2 User Content and License
You may be permitted to create, submit, post, or otherwise make available messages, chat content, images, gameplay captures, artwork, or other materials through the Services or on MagLab’s official channels (collectively, “User Content”). You retain ownership of your User Content; however, by submitting it, you grant MagLab and its affiliates a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, transferable, and fully sublicensable license to use, reproduce, adapt, modify, translate, publish, distribute, publicly perform, and display such User Content, in whole or in part, for the operation, improvement, marketing, and promotion of the Services and MagLab’s business activities.
This license includes the right for MagLab to use your User Content in any media now known or later developed, without further notice, approval, or compensation. MagLab has no obligation to use any User Content, and submission does not create any employment, partnership, or compensation relationship between you and MagLab.
By submitting User Content, you represent and warrant that:
- You own or have the necessary rights, licenses, and permissions to grant the above license to MagLab;
- Your User Content does not infringe or violate any copyright, trademark, trade secret, privacy, publicity, or other proprietary rights of any third party; and
- Your User Content complies with all applicable laws and these Terms.
MagLab reserves the right, but not the obligation, to monitor, review, remove, or restrict access to any User Content that, in its sole discretion, violates these Terms or is deemed inappropriate, illegal, or harmful to the community. MagLab assumes no responsibility or liability for User Content posted by you or other users, or for any loss or damage resulting from its use or publication by others.
You acknowledge and agree that MagLab may store, transmit, and use your User Content in connection with the operation and development of the Services, and that User Content shared in public forums or communications channels may be visible to other users.
4.3 Trademark and Brand Usage
All names, logos, characters, trade dress, and other trademarks or service marks appearing within the Services — including, without limitation, the “MagLab” name, logo, and related branding — are the exclusive property of MagLab Game Technologies, its affiliates, or licensors. Nothing in these Terms grants you any rights to use MagLab’s trademarks, service marks, or trade names, whether for commercial or non-commercial purposes, without prior written authorization.
You agree not to copy, imitate, or use any MagLab trademark or trade dress, in whole or in part, in a manner that is likely to cause confusion among consumers, misrepresent an association with MagLab, or dilute MagLab’s brand value or goodwill. This includes using MagLab’s trademarks in domain names, social media accounts, fan pages, or other online identifiers without permission.
Fan art, fan websites, or community projects that make limited use of MagLab intellectual property for non-commercial, creative, or commentary purposes may be tolerated at MagLab’s discretion, provided such use is appropriate, non-deceptive, and does not compete with or harm MagLab’s reputation or commercial interests. However, MagLab reserves the right to request the modification or removal of such content at any time.
All goodwill arising from the authorized use of MagLab trademarks shall inure exclusively to the benefit of MagLab. Unauthorized use of any MagLab mark, including in meta tags or advertising keywords, constitutes infringement and may result in legal enforcement action.
5. Purchases and Payments
5.1 Virtual Items and In-App Purchases
Certain Services provided by MagLab may offer the ability to purchase virtual, in-game items such as virtual currencies, premium features, or consumable digital goods (“Virtual Items”). These Virtual Items have no real-world monetary value and are licensed—not sold—to you for use solely within the context of the Services. You acknowledge that the purchase of Virtual Items does not transfer any ownership rights, and such items are not redeemable or exchangeable for cash or other goods outside the Services.
All purchases of Virtual Items are final once completed and are subject to the payment terms, conditions, and policies of the third-party platform (such as the Apple App Store or Google Play Store) from which the Services are downloaded. MagLab is not responsible for managing or authorizing payment transactions processed through these platforms. You agree that MagLab has no obligation to provide a refund for any unused Virtual Items or in the event that your account is suspended, terminated, or otherwise disabled due to violation of these Terms.
MagLab reserves the right to modify, manage, or eliminate Virtual Items at its discretion, with or without notice, and without liability to you. The availability of Virtual Items and their prices may vary depending on your geographic location, platform, or payment provider. You agree that all such changes are part of the Services and do not entitle you to any form of compensation or refund.
5.2 Pricing and Taxes
Prices for Virtual Items or premium content within the Services are displayed in your local currency when applicable, and may include or exclude taxes depending on local regulations. MagLab does not guarantee that any particular Virtual Item or pricing will remain available for any period of time. Prices may be adjusted periodically to reflect market conditions, currency fluctuations, tax changes, or promotional activities.
You are responsible for paying all fees, taxes, and charges associated with your use of the Services, including any applicable value-added tax (VAT), goods and services tax (GST), or other local duties required by law. MagLab reserves the right to collect and remit such taxes as legally required.
If a payment is reversed, canceled, or disputed, MagLab may, at its discretion, revoke access to the related Virtual Items or suspend your account until the issue is resolved. Continued disputes may result in permanent account termination or legal action to recover losses.
5.3 Refund Policy and Exceptions
All purchases made within the Services — including those for virtual currency, consumable in-game items, or premium content — are final and non-refundable, except as expressly required by applicable consumer protection laws or as otherwise determined at MagLab’s discretion. Once a transaction has been completed and the purchased content made available to your account, you do not have the right to cancel or request a refund merely because you have changed your mind, discontinued use of the Services, or are dissatisfied with in-game progress or performance.
Refunds may be granted only in exceptional circumstances, including but not limited to:
- A confirmed technical malfunction on MagLab’s side that prevented proper delivery or use of a purchased item despite successful payment;
- A duplicate transaction caused by a verified system or network error;
- An unauthorized purchase made without your consent and reported promptly following discovery;
- A case where applicable consumer protection law (for example, in the European Union, United Kingdom, or Brazil) mandates a refund within a specified legal framework.
If you believe you are eligible for a refund, you must submit your request through the platform provider used for the original purchase (for example, the Apple App Store, Google Play Store, or other authorized marketplace). MagLab does not directly handle or process financial transactions made through these third-party platforms, and therefore cannot issue direct monetary refunds to users.
In certain cases where platform rules permit, MagLab may assist in verifying your claim by providing documentation or confirming technical errors to the respective payment processor. However, the final decision on refund approval rests with the platform provider and must comply with their applicable terms and refund procedures.
If a refund is approved by either MagLab or the platform provider, MagLab reserves the right to deduct or revoke any Virtual Items, in-game currency, progress, or benefits associated with the refunded transaction. You acknowledge that a refund effectively reverses your license to use the purchased content, and MagLab may adjust your account balance accordingly to reflect this reversal.
Users found to be abusing refund mechanisms, engaging in repeated refund requests without valid cause, or submitting fraudulent claims may have their accounts temporarily suspended or permanently terminated. Such users may also be denied future access to MagLab Services or purchases.
Refunds, when approved, will be made using the same payment method employed for the original transaction. The processing time for refunds may vary depending on your platform, payment provider, or geographic region. MagLab bears no responsibility for delays caused by third-party intermediaries such as app stores or banks.
Nothing in this section limits or excludes any rights you may have under mandatory consumer protection laws. In jurisdictions where a statutory cooling-off period applies, users may have the right to withdraw from a digital purchase within a limited timeframe (for example, 14 days in the European Union), provided that the digital content has not yet been accessed or downloaded. Once access or download has occurred, you expressly waive such withdrawal rights.
By completing any in-app or in-game purchase, you acknowledge and agree that:
- You have reviewed the pricing and item description prior to purchase;
- You authorize MagLab or its payment partners to charge your selected payment method for the stated amount;
- You understand that Virtual Items have no real-world monetary value and cannot be exchanged or redeemed for cash or tangible goods; and
- You accept that all transactions are final and subject to the provisions of this section.
MagLab may amend or update this Refund Policy at any time to comply with evolving laws, platform requirements, or business practices. Any changes will be effective upon publication within these Terms, and your continued use of the Services will constitute acceptance of the updated policy.
6. Advertising, Analytics, and Third-Party Services
6.1 Advertising Networks and SDKs
MagLab may integrate third-party advertising networks, software development kits (SDKs), and analytics tools within its Services to deliver relevant advertisements, measure performance, and improve user experience. These third-party partners may collect certain technical or behavioral information, such as device identifiers, ad interactions, and general location data, to provide personalized ad content.
While MagLab carefully selects and contracts with such partners, it does not control their independent data processing practices. By using the Services, you acknowledge and consent to the collection and use of such data by authorized third parties in accordance with applicable privacy laws and MagLab’s Privacy Policy.
6.2 Data Sharing and Cookies
To optimize gameplay, improve stability, and provide targeted experiences, MagLab and its partners may use cookies, local storage, or similar tracking technologies. These tools enable features such as saving login states, customizing advertising, monitoring service performance, and detecting fraud or unauthorized access.
Collected data may include technical identifiers, IP addresses, device model, operating system, gameplay activity, and purchase history. MagLab processes this data under legitimate interests for service operation and improvement, while ensuring compliance with global data protection standards, including the General Data Protection Regulation (GDPR) and Law on Personal Data Protection (KVKK).
6.3 User Opt-Out and Control Mechanisms
You have the right to manage your privacy preferences and restrict personalized advertising at any time. Device settings (such as “Limit Ad Tracking” on iOS or “Opt-out of Ads Personalization” on Android) allow you to disable interest-based advertising. You may also adjust cookie preferences in your browser or within the Services where applicable.
Users in the European Economic Area, the United Kingdom, Brazil, and California may exercise additional rights, including the right to request access, correction, deletion, or restriction of personal data, as described in MagLab’s Privacy Policy.
MagLab encourages all users to review the Privacy Policy regularly to understand how personal data is collected, shared, and protected, as continued use of the Services constitutes acceptance of the practices outlined therein.
7. Suspension and Termination
7.1 Termination by MagLab
MagLab reserves the right, at its sole discretion, to suspend, restrict, or permanently terminate your access to the Services, or any part thereof, at any time and for any reason, with or without prior notice. Grounds for such termination may include, but are not limited to:
(a) violations or suspected violations of these Terms;
(b) fraudulent, deceptive, or illegal activity, including unauthorized access or manipulation of game systems;
(c) cheating, exploitation of bugs, use of third-party automation or hacking tools, or manipulation of in-game mechanics;
(d) abusive or harassing behavior toward other users or MagLab personnel;
(e) behavior that threatens the integrity, fairness, or stability of the Services; or
(f) noncompliance with applicable laws or platform policies.
In addition, MagLab may suspend or terminate accounts that are inactive for extended periods (typically 12 months or longer), associated with multiple policy infractions, or otherwise deemed to pose operational or security risks. Prior to termination due to inactivity, MagLab may send a notice to the registered email address or via in-app notification when feasible.
In serious cases involving misconduct, cheating, payment fraud, or chargeback abuse, MagLab may impose a permanent ban across all MagLab games, applications, and associated platforms without prior notice. MagLab may also block the device or account credentials linked to such activities to prevent further misuse.
MagLab has no obligation to provide advance warning or to disclose the specific reason for an account’s suspension or termination where such disclosure could interfere with investigations, enforcement actions, or the integrity of the Services. All decisions regarding suspension, restriction, or termination are final and made at MagLab’s sole discretion.
Users whose accounts have been suspended or terminated may, in certain cases, submit an appeal through MagLab’s customer support. Appeals must include sufficient identifying information and a clear explanation for reconsideration. MagLab may, but is not obligated to, review appeals or restore account access, and restoration is not guaranteed.
7.2 Termination by User
You may terminate your account and discontinue use of the Services at any time by deleting your MagLab account, uninstalling MagLab applications from your devices, or ceasing access to the Services. Account deletion requests may be processed through in-game account settings or by contacting MagLab via [email protected].
Upon voluntary termination, you acknowledge and agree that:
(a) your account will be permanently deleted and cannot be recovered;
(b) you will lose access to all gameplay data, progress, and Virtual Items associated with your account; and
(c) you are not entitled to refunds or compensation for any purchased content, unused Virtual Items, or unused subscription periods.
MagLab may retain certain personal data after account termination to the extent required by applicable laws, including for compliance, auditing, dispute resolution, or fraud prevention purposes. Such data will be securely stored and processed in accordance with MagLab’s Privacy Policy and applicable data protection regulations, including the General Data Protection Regulation (GDPR) and equivalent laws in other jurisdictions.
If you later decide to return to the Services, you may be required to create a new account and accept the then-current version of these Terms. Any data, content, or purchases linked to your previous account will not be restored.
7.3 Effects of Termination
Upon termination—whether initiated by MagLab or by you—your license to use the Services and all related content, including Virtual Items and premium features, immediately ceases. You must promptly cease all use of MagLab’s Services and delete any related software, files, or content from your devices.
All in-game progress, achievements, communications, and account data associated with your user profile may be permanently deleted without the possibility of recovery. MagLab is under no obligation to maintain, provide, or restore any user data after account termination, nor to compensate you for any loss of access to digital content, purchases, or Virtual Items.
Termination does not relieve you of any obligations accrued prior to the effective date, including outstanding payments, indemnities, or breaches of these Terms. MagLab retains the right to pursue appropriate remedies, including legal action, for any damages resulting from violations of these Terms, unlawful behavior, or misuse of its intellectual property.
All provisions of these Terms that, by their nature, should survive termination shall continue in full force and effect. This includes, but is not limited to:
- Ownership and Intellectual Property Rights;
- License Limitations;
- Disclaimers of Warranties;
- Limitations of Liability;
- Indemnification; and
- Dispute Resolution and Governing Law.
Termination or expiration of your account shall not affect any rights or obligations that accrued prior to such termination. MagLab’s failure to enforce any provision of these Terms following termination shall not be construed as a waiver of its rights to do so in the future.
8. Updates and Modifications to the Service
8.1 Software Updates
MagLab may periodically develop, release, and deploy updates, patches, upgrades, enhancements, or modifications to its software and Services in order to improve functionality, introduce new content, enhance gameplay balance, increase system stability, address security vulnerabilities, or fix technical defects. These updates are an essential part of the ongoing operation and evolution of the Services and may be applied automatically, without prior notice or additional consent, in order to ensure a consistent and secure user experience.
By continuing to access or use the Services after any update or modification, you acknowledge and agree to the updated version of the Services and accept that such updates may change certain gameplay features, mechanics, or user interfaces. MagLab does not guarantee that any particular feature or version will remain available or unchanged. Updates may also alter the system requirements necessary for use, and in some cases, older devices or operating systems may become incompatible.
You are responsible for ensuring that your device and network environment meet the technical requirements necessary for the proper functioning of the Services. MagLab shall not be liable for any failure to access or use the Services resulting from outdated software, insufficient device storage, incompatible system versions, or lack of connectivity.
In some cases, MagLab may request that you manually install a major update or new version in order to continue using the Services. Failure to install required updates may result in loss of functionality, inability to access your account, or discontinuation of support for older versions.
MagLab may, at its discretion, roll back or modify updates if technical issues, instability, or player-impacting defects are discovered. The Company reserves the right to disable, archive, or remove outdated builds or unsupported versions to maintain service integrity.
All updates, regardless of nature or size, are considered part of the Services and subject to these Terms. You agree that MagLab has no obligation to provide future updates, expansions, or maintenance beyond what is reasonably required for operational continuity.
8.2 Service Availability
MagLab strives to maintain reliable and continuous operation of its Services and to minimize interruptions whenever possible. However, uninterrupted or error-free operation cannot be guaranteed, and the Services are provided on an “as available” basis. Temporary interruptions may occur as a result of routine or emergency maintenance, technical malfunctions, software updates, network congestion, force majeure events, or other causes beyond MagLab’s reasonable control.
During such periods, MagLab may temporarily suspend or limit access to certain features or Services to perform maintenance or resolve technical issues. Where feasible, MagLab will provide notice in advance of scheduled maintenance through in-game notifications, official social media accounts, or website announcements. However, you acknowledge that MagLab may, at its discretion, perform urgent maintenance without prior notice if necessary to protect the security or stability of the Services.
MagLab shall not be responsible for any losses or damages arising from downtime, including the loss of gameplay progress, Virtual Items, leaderboard status, achievements, or any other in-game data. You are encouraged to ensure your device maintains a stable internet connection and to regularly back up relevant data, if supported, to reduce the risk of loss.
MagLab also reserves the right to modify, suspend, restrict, or permanently discontinue any portion of the Services or related features at any time for business, operational, legal, or security reasons. This may include retiring certain games, game modes, or regional servers. In the event of a permanent discontinuation of a Service, MagLab will make reasonable efforts to notify users in advance where possible.
Unless otherwise required by applicable law, no refunds or compensation will be provided for discontinued Services, lost Virtual Items, or terminated features. You acknowledge that MagLab retains full discretion over the lifecycle of its Services, and that changes, updates, or discontinuations do not constitute a breach of these Terms.
MagLab shall not be liable for performance delays or failures caused by events outside its reasonable control, including natural disasters, acts of government, power outages, network failures, cyberattacks, or third-party service interruptions. In such cases, MagLab may take reasonable steps to restore Services as soon as practicable but is under no obligation to provide restitution for downtime or data loss.
By continuing to use the Services, you expressly acknowledge that MagLab’s operational needs may require modifications, temporary suspensions, or terminations of its offerings, and that such actions are fundamental to maintaining the long-term quality, balance, and security of the MagLab ecosystem.
9. Disclaimer of Warranties
9.1 “As Is” Provision
The Services, including all games, applications, Virtual Items, software, features, and related content provided by MagLab, are offered to you strictly on an “as is,” “as available,” and “with all faults” basis. To the fullest extent permitted by applicable law, MagLab, its affiliates, licensors, and service providers expressly disclaim all representations, warranties, and conditions of any kind — whether express, implied, or statutory — including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, satisfactory quality, security, accuracy, quiet enjoyment, and availability.
MagLab does not represent or warrant that the Services will meet your expectations or that they will be uninterrupted, timely, secure, error-free, or free of harmful components. No oral or written advice or information obtained from MagLab or through the Services shall create any warranty not expressly stated in these Terms. You acknowledge that your use of the Services is entirely at your own risk and that you bear sole responsibility for any consequences resulting from your use, download, or reliance on any content, data, or materials provided through the Services.
Without limiting the foregoing, MagLab does not guarantee that:
- The Services or servers will operate without interruption, delay, degradation, or defects;
- The Services will be free of viruses, malware, harmful code, or unauthorized access;
- Defects or malfunctions will be corrected within a specific timeframe;
- Any in-game data, progress, or customization will be preserved after updates, crashes, or account changes; or
- The Services will be compatible with every device, operating system, or network environment.
You are solely responsible for implementing adequate safeguards and security measures to protect your device, account credentials, and personal data from unauthorized access, loss, or corruption. MagLab disclaims any liability for damages arising from your failure to maintain the security of your device or account.
Furthermore, MagLab does not warrant or guarantee that any specific gameplay experience, feature, ranking, or in-game achievement will remain available or consistent over time. Gameplay balance, item statistics, and user progression systems may be modified, rebalanced, or removed at any time as part of the ordinary management of the game. These changes may affect your experience or perceived value of certain Virtual Items, achievements, or features, and you acknowledge that such changes do not constitute a defect or breach of warranty.
To the extent permitted by law, MagLab does not assume any obligation to maintain, support, update, or upgrade the Services, except where required for essential functionality or compliance with legal obligations. Any maintenance, modification, or removal of content is conducted solely at MagLab’s discretion.
In some jurisdictions, the exclusion of certain implied warranties may not be allowed. In such cases, MagLab’s liability shall be limited to the minimum extent permitted by applicable law, and any warranties that cannot be disclaimed shall be limited to a period of thirty (30) days from your initial use of the Services.
You understand and agree that you use the Services entirely at your own discretion and risk, and that MagLab shall not be held responsible for:

By continuing to access or use the Services, you acknowledge and agree that you have not relied on any statement, promise, representation, or warranty that is not expressly set forth in these Terms.
9.2 No Guarantee of Availability or Error-Free Operation
MagLab does not guarantee or warrant that its Services, or any content, functionality, or features therein, will be available at all times, uninterrupted, secure, or free from errors or defects. The performance and availability of the Services may be affected by a variety of factors, including scheduled or unscheduled maintenance, software updates, network congestion, hardware failures, cyberattacks, system overloads, or circumstances beyond MagLab’s reasonable control, such as acts of nature, war, labor disputes, government actions, or technical malfunctions of internet service providers or third-party platforms.
You acknowledge and agree that temporary interruptions, latency, bugs, and data inconsistencies are inherent risks of online and digital services, and that such occurrences do not constitute a breach of these Terms or grounds for compensation. MagLab expressly disclaims any responsibility for harm, loss, or damage that may arise due to Service interruptions, data corruption, connection instability, or inability to access or use the Services.
In particular, MagLab shall not be liable for any loss of data, progress, gameplay results, in-game currency, or Virtual Items resulting from system outages, account issues, or network interruptions. You are solely responsible for maintaining adequate internet connectivity, device performance, and data backups (if applicable) to safeguard your gameplay information.
While MagLab makes every reasonable effort to ensure the security and stability of its Services, it cannot guarantee protection against all unauthorized access, hacking attempts, data breaches, or malicious software. Users are encouraged to employ safe password practices, enable device security measures, and immediately report any suspected unauthorized activity to MagLab support.
To the maximum extent permitted by applicable law, MagLab makes no representations or warranties regarding the accuracy, reliability, completeness, timeliness, suitability, or quality of the Services, and expressly disclaims any warranties arising from course of dealing, usage, or trade practice.
You further acknowledge that your experience may vary based on your hardware, device configuration, and network conditions, and that MagLab is under no obligation to ensure compatibility with all devices, platforms, or operating systems. Any reliance on the availability or uninterrupted operation of the Services is solely at your own risk.
Where required by applicable law, MagLab will make reasonable efforts to restore access to the Services following an interruption, but does not guarantee recovery of data or restoration of gameplay progress. You understand that periodic downtime and technical maintenance are essential for ongoing improvement, balance, and security, and that these activities may result in temporary loss of access or features.
10. Limitation of Liability
10.1 Exclusions and Limitations
To the fullest extent permitted by applicable law, MagLab, its affiliates, licensors, partners, directors, officers, employees, contractors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your access to or use of the Services. This includes, without limitation, damages for loss of profits, loss of revenue, loss of data, loss of goodwill, business interruption, system failure, or personal injury, even if MagLab has been advised of the possibility of such damages.
This limitation applies whether the alleged liability arises from contract, tort, negligence, strict liability, or any other legal theory, and regardless of whether MagLab could have foreseen such damages. MagLab shall not be liable for the conduct of third parties, including users, advertisers, or external service providers integrated into the Services.
In no event shall MagLab’s total cumulative liability to you for any and all claims, damages, losses, or causes of action exceed the total amount you have paid (if any) to MagLab for use of the Services during the twelve (12) months immediately preceding the event giving rise to the claim. If you have not made any payments to MagLab during that period, your sole and exclusive remedy shall be to discontinue your use of the Services and uninstall any related applications.
Certain jurisdictions do not allow limitations on implied warranties or exclusions of incidental or consequential damages. In such jurisdictions, the foregoing limitations and exclusions shall apply to the fullest extent permitted by law, and MagLab’s liability shall in no event exceed the minimum amount required under applicable law.
You acknowledge that the limitations of liability set forth herein form an essential basis of the bargain between you and MagLab, and that without such limitations, the Services and related content could not be offered under the same economic terms or availability.
10.2 Sole and Exclusive Remedies
Your sole and exclusive remedy for dissatisfaction with the Services, including any content, features, updates, or gameplay mechanics, is to cease using the Services and delete any associated MagLab applications from your device. You acknowledge that the fees and pricing associated with MagLab’s offerings reflect an allocation of risk and that MagLab would not provide the Services on the same terms without such limitations.
If any component of the Services is found to be defective, unavailable, or delayed, MagLab’s sole obligation—where required by applicable law—shall be to make reasonable efforts to correct the defect, restore access, or provide an equivalent replacement of equal value at its discretion. Such remedial actions shall be provided as a courtesy, not as a right or guarantee.
MagLab shall have no obligation to compensate for any indirect effects of Service defects or downtime, including lost game progress, disrupted gameplay sessions, or lost user interactions. You agree that these limitations are a fair and reasonable allocation of risk between you and MagLab in light of the nature of online entertainment services.
These remedies are exclusive and replace any other remedies that might otherwise exist under applicable law, except where those cannot legally be excluded.
11. Indemnification
11.1 User’s Responsibility
You agree to defend, indemnify, and hold harmless MagLab Game Technologies Ltd. Şti., its affiliates, subsidiaries, officers, directors, employees, agents, licensors, partners, and service providers from and against any and all claims, actions, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees and investigation expenses) arising out of or in connection with:
- Your violation or alleged violation of these Terms or any applicable law or regulation;
- Your misuse, abuse, or unauthorized use of the Services;
- Your breach of any representation, warranty, or obligation made under these Terms;
- Your infringement or alleged infringement of any third-party rights, including but not limited to intellectual property, publicity, confidentiality, or data protection rights;
- Any content, data, or material you upload, transmit, distribute, or otherwise make available through the Services; or
- Any dispute between you and another user or third party in connection with your use of the Services.
This indemnification obligation shall survive the termination of your account and the cessation of your use of the Services. You agree that MagLab reserves the right to claim indemnity even after your account has been deleted if your conduct while using the Services gives rise to liability or loss.
11.2 Cooperation with MagLab
You agree to fully cooperate with MagLab in the defense of any claim, investigation, or legal proceeding arising from or relating to your use of the Services. This includes providing documents, communications, or other evidence reasonably requested by MagLab and appearing, if necessary, as a witness in any related action.
MagLab reserves the exclusive right to assume the defense and control of any matter subject to indemnification by you. In such cases, you shall not settle, compromise, or otherwise resolve any claim without MagLab’s prior written consent.
MagLab will make reasonable efforts to notify you of any such claim, action, or proceeding requiring your cooperation. Failure to cooperate may result in MagLab seeking reimbursement for additional damages, legal fees, or costs incurred due to your lack of compliance.
Nothing in this section limits MagLab’s right to participate in the defense of claims at its own expense or to seek independent remedies against users whose conduct causes harm or reputational damage to the company.
12. Dispute Resolution and Governing Law
12.1 Applicable Law
These Terms, and any disputes arising out of or relating to them or to your use of the Services, shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of law principles.
If you reside outside Türkiye, mandatory consumer protection laws in your jurisdiction may also apply to your relationship with MagLab, to the extent required by those laws.
12.2 Arbitration and Class Action Waiver
To the fullest extent permitted by applicable law, any dispute, claim, or controversy arising out of or in connection with these Terms or the Services shall be resolved through the Tüketici Hakem Heyeti (Consumer Arbitration Committee) or the competent Tüketici Mahkemesi (Consumer Court) in accordance with the provisions of the Law No. 6502 on the Protection of Consumers and relevant secondary legislation.
The jurisdiction of the Tüketici Hakem Heyeti or Tüketici Mahkemesi shall be determined based on the consumer’s place of residence at the time of the dispute or where the transaction took place. The language of proceedings shall be Turkish, and decisions shall be binding in accordance with the applicable consumer protection framework.
You and MagLab agree that any dispute resolution shall be conducted solely on an individual basis, and that class actions, class proceedings, or representative claims are not permitted. You waive any right to participate as a plaintiff or class member in any collective or representative proceeding against MagLab.
Each party shall bear its own legal costs and expenses unless otherwise determined by the Tüketici Hakem Heyeti or the competent court under the applicable laws of Türkiye.
13. Amendments and Updates to Terms
13.1 Notification of Changes
MagLab reserves the right to revise, amend, or update these Terms of Use at any time to reflect changes in the law, new business practices, or modifications to the Services. When changes are made, the updated Terms will be posted within the Services and on the official MagLab website, with the “Last Updated” date revised accordingly.
Where required by law or deemed material by MagLab, reasonable notice will be provided—such as an in-app notification, email alert, or other suitable form of communication—prior to the effective date of the revised Terms.
13.2 Continued Use as Acceptance
Your continued access or use of the Services following any update to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the new version, you must discontinue use of all MagLab Services immediately and delete any associated software or applications from your devices.
No waiver of any provision in these Terms shall be deemed a continuing waiver unless expressly stated in writing by MagLab. MagLab encourages you to review these Terms periodically to remain informed of your rights and obligations.
